In his recent Press conference Kabil Sibal has defended the UPA in 2 G spectrum scam very meekly. But he made a reference to the fact there had been a prima facie wrong committed in the allocation of 2 G spectrum.But he classified it as a proceedural fault. But that is what lead to the scam. Kabil's defence was that the CAG figures of presumptive losses are erroneous.Kabil Says there is no loss or the loss is zero. and not 1.75 lakh crores.So what ? The magnitude of the presumptive loss is not the question. Kabil sibal took pains to explain, by the same logic, the NDA government during its regime would have suffered a presumptive loss of Rs 1.5 lakh crores.But the question is, was there any impropriety in the allocation of 2G spectrum.?To this kabil sibal answers in the affirmative and says it was a procedural mistake . But again the question to be answered is was there a deliberate intent to commit procedural wrongs? For major part of his press conference Kabil Sibal tried to say it was erroneous on the part of CAG to have reported a wrong presumptive loss.He also went on to say 'To err is human'. Kabil was magnanimity personified in the press meet.He was just short of saying "To forgive is divine'".I am sure the BJP would now come out with its rejoinder to Kabil Sibal.We would have to wait and see how BJP's eminent lawyers Jaitley and Ravi Shankar Prasad counters this press meet of Kabil sibal.One thing is sure it would be nothing more than a spat between two political parties.Instead of engaging in a war of words the BJP and congress should agree to some points and move forward and punish the guilty,come what may.The system should have enough checks and balances to avoid any such recurrences in future.Also the government should try to make good the loss suffered to the government exchequer because of this spectrum allocation. Kabil did say that some amount has been recovered by the government from those companies to whom Kabil has served the notice.It would be prudent to study the international practices of spectrum allocation and arrive at a fool proof solution at least for the future.I agree even in the international arena it is considered as a complex issue,but there have been no scams in other nations in the allocation of spectrum.How could they manage ?What are the checks in the system. I am sure Kabil wold surely pay his attention to this and would be open to a debate about this in parliament and would come out with a fool proof solution at least for the future.
